form ( word format) to our head office, with the postal
order or the cheque stub attached.

Every subscription implies that the subscriber has been
informed about the terms and conditions of the
subscription to Procom International Internet
and
has accepted them .
All the
fields followed by ( *
) must be completed.
The
subscription terms
1- This agreement determines
the conditions and clauses of use of the access service
to the Internet (named hereafter "the service")
provided to the user (named hereafter "the subscriber")
by Procom International (named hereafter the provider) .
The user accepts this hereby agreement upon subscription to the service and
its use . The service conditions and clauses can be
modified at the provider's sole discretion .These
modifications will be notified to the user by the
E-mail or by any other means .
Subscribers Rights
and duties
2- The services provided by the
provider to the subscriber include :
- The access to the Internet for a given period and cost
and under the conditions settled by the subscription
agreement signed by the subscriber to the provider
.
- The free use of an electronic address .(e-mail) and an
electronic box lodged in the provider's message server
.
- A free attribution , called by the subscriber , of a disk-space
on the provider's web server, for one or more web pages.
- A free access to all the free services offered by
the provider to his subscribers .
3- The services are provided to the subscriber
for personal or business purposes only .The subscriber cannot
give up or transfer his subsciption contract to any
person or firm without prior written agreement from the provider
, he is not allowed to share his account with any other person or let
anyone use it .
The subsciber is fully reliable for the risks
and the consequences of the disclosure of his codesof access
to the service , his password and in general , of
all the mail , information , and the data considered confidential .
4- To allow fluidity of the service
, and for the common benefit of the subscibers (except for
those who subscribed for a private line from the provider),
the subscriber contracts :
- To call the service , with only one modem at a time.
- Not to overuse the service in terms of time and resources
- To allow the other subscribers fair availability of the
service using it intermittently and disconnecting from the
system after 20 minutes when inactive.
- All kind of abuse, resulting from the non respect of rules
can lead to the withdrawal of the subscription without previous
notice .
5- The subscriber has the right to use the
electronic mail for his business or for personal use
.
The electronic mail includes all messages, advertisements ,
an audio or video graphic file,, as well as other
materials compatible with the norms of the electronic mail .
The subscriber should, however respect the rules in use on the
Internet when using this service , never taking the
liberty of sending unrequested mail, never
harassing,disturbing or
drowning the members of the Internet community in junk
mail.
The subscriber cannot use the Usenet conferences and the
newsgroups/ forums for commercial or advertising purposes,
when those conferences and forums do not allow this kind
of use
in their regulations .
6- The subscriber can use the service to download
software. He takes upon himself the complete responsibility
to determine whether the software is public property or
not .
7- The subsciber has one or more free pages
on the provider's server ,not exceeding thedisc- space as
defined in the subscription agreement . Those web pages
must not be of a commercial type .Whenever they are,
the provider has the right to invoice them at the prices applied to the commercial web sites it is
hosting,
and this,at the commencementof the contract signed by the
subscriber .
Provider's rights and duties
8- In order to insure the best possible access conditions
to the service, the provider will do his best , in the limits
of readinessof his telephone lines, to maintain the international
ratio of available lines per subsciber (10 for one
line ).
However, the provider can't guarantee full access ,any time,
to all the subscribers,unless the subscriber has signed
for a private line with the provider .
In any case, the Provider is not liable for any obstacle,obstruction,failure,delay
in performance or any other incident in connection with
the telephone network conditions.
9- The commencement
dateof the subscription to the service is the one the provider
activates the subsciber's account .
When the subscribtion is terminated and is not renewed,
the provider undertakes to maintain the subscriber,to the
exclusion of all other services,in the use of his electronic
boxand his address for a period that will not exceed 8 days
to avoid the trouble of an interruption of his E-mail correspondence
.
The provider has the right to modify his tariff at any time
.
10- The
subsciption is payable in advance for the period specified
in the subscription contract . It is not refundable .
It is will not be reimbursed unless the responsi bility
of the provider is clearly established in the execution
of the hereby contract , excluding all the cases when this
responsibility could not be engaged following the terms
of the hereby contract .
The provider has the right to interrupt ,without prior notice,
the service of any subscriber who doesn't respect the conditions
stipulated in the hereby contract .
Conditions and general modalities
of the service utilization
11- The provider's service can only be used for legal purposes . The subscribtion will immediately be
cancelled if the subscriber does not respect the rules in
practice on the Internet as defined by the 'Netiquette'
12- The subscriber is the only one liable :
- For all information or datum acquired through the provider
.
- For all the links or relations established through the
service .
- And generally speaking , for all the uses made of the service
access.
13- Under no circumstance will the provider
be liable:
- In case of request or compensation following use or
abuse of the service, related to a content placed or published
on the Internet by the subsciber .
- In the case of legal action against the subscriber for
an eventual abuse of the service use or for any of the provider's
service .
- For any failure or any anomaly in the service and for the
consequent damages caused to the user .
- For the reliability and for the rapidity of data transmission
by the provider .
- For eventual problems of access to the Internet or
to the services connected to it .
14- As far as minors are concerned,the responsibility
for their use of the service is held by their parents or
the persons who are civilly responsible for them . The provider
cannot , in any case, be held responsible for this kind
of use , or for any consequences resulting from it.
15- The provider has the right to interrupt , without
previous notice, the service of any subscriber who doesn't
respect the conditions stipulated in the hereby contract
and the right to decide whether to refund the total prepaid amount
.
